Abstract

O Direito de Autor é muitas vezes visto como uma entidade autónoma incrustada na realidade jurídica, as suas normas são tidas como que pertencendo a um corpus aristocrático, desgarrado e com vida própria no mundo do Direito, mas a ordem jurídica é una e o Direito de Autor não é absoluto, sendo o seu conteúdo resultante de um somatório das componentes positivas e negativas. Para o resultado, na delimitação e compreensão do Direito, tanto contribuem os poderes e faculdades como as exceções e limites, quer intrínsecos quer extrínsecos ao próprio Direito de Autor. Partindo da regra, que é a liberdade, e da génese e razão de ser do Direito de Autor, passando pela sua crescente hipertrofia impulsionada e ditada, as mais das vezes, por interesses alheios ao criador intelectual, analisam-se as fronteiras do Direito de Autor, quer impostas pela própria regra da liberdade quer pelos Direitos humanos codificados, que necessariamente a refletem. O espaço de liberdade foi-se contraindo na razão inversa da expansão do monopólio conferido ao titular dos direitos de exploração. Por outro lado, o Direito de Autor construído com o fim último de, recompensando o autor pelo seu labor intelectual, incentivar o progresso da sociedade, vê-se refém dos interesses das editoras, produtoras e outras para quem o autor foi por vezes compelido, para que a sua obra visse a luz do dia, a transferir os direitos patrimoniais. A contracção do espaço de liberdade reduz-se tendencialmente ao gozo passivo dos bens culturais.

Copyright is often seen as an autonomous entity embedded in the legal reality, its rules are considered to be a part of an aristocratic, detached body with a life of its own in the world of Law, but the legal system is one and Copyright is not an absolute, being its content the result of the sum of positive and negative components. For the result, in drawing boundaries and understanding Law, both powers and faculties as well as exceptions and limitations, either intrinsic or extrinsic to Copyright itself, give a contribution. Based on the rule which is freedom, as well as on the origin and purpose of Copyright, covering its growing hypertrophy, often driven and imposed by interests alien to the intellectual creator, the boundaries of Copyright are analysed, either imposed by the rule of freedom itself or by the coded human Rights, which necessarily reflect it. The area of freedom has been contracting itself inversely to the expansion of the monopoly granted to the holder of economical exploitation rights. On the other hand, Copyright built with the ultimate purpose of encouraging the progress of society, by rewarding the author for his intellectual labour, becomes a hostage of publishers, producers and other companies' interests for whom the author was sometimes compelled to transfer its economical exploitation rights so that his work could see the light of day. The area of freedom, due to its continuous contraction, tends to be reduced to the passive enjoyment of cultural assets.
