A busca da verdade é a razão que norteia a atividade judicial. No processo penal esta busca tem início na identificação do suspeito, da pessoa que praticou o crime. Este trabalho procurou lançar um olhar judiciário (crítico) sobre o modo como a prova por reconhecimento de pessoas se encontra configurada no nosso sistema penal e sobre as práticas da realização da mesma, com especial incidência para as questões práticas que se colocam ao julgador. Nas palavras do Tribunal Constitucional que espelham bem a verdade judiciária, o auto de reconhecimento da identidade do suspeito, “(…) tende a merecer, na prática judiciária, um valor probatório reforçado, funcionando quase como uma presunção de culpabilidade do suspeito, pelo menos na fase indiciária" (…)”1 Sendo o reconhecimento a evocação de uma imagem mnemónica, o mesmo encontra-se associado a um elevado risco de erro, que o legislador reconhece e tenta acautelar através da adoção de procedimentos rigorosos. Contudo uma vez instalada a dúvida sobre o rigor com que um reconhecimento foi realizado, não pode o julgador depositar nele a sua confiança, sobretudo porque não tem qualquer mecanismo de controlo do que efetivamente sucedeu no ato de reconhecimento. Não seriam necessárias grandes alterações legislativas para que este meio de prova pudesse oferecer, a quem tem de julgar, um maior grau de segurança e de confiança. Assim, a par sistematização das questões colocadas ao julgador, procurou-se deixar refletida a jurisprudência dos tribunais superiores quanto às mesmas. A parte final deste trabalho é constituída por sugestões de mudança que visam, no essencial, permitir ao juiz de julgamento um efetivo controlo sobre a forma como foi feito o reconhecimento para que com segurança possa decidir se o arguido é ou não o autor do crime.
Searching for the truth is the reason that guides all the judicial activity. The criminal proceedings begin with the identification of the suspect, i.e. the person who committed the crime. This study sought to look with a critical judicial eye how the identification of people is configured in our criminal justice system and its practices, with a particular focus on the practical issues the judge faces. The words of the Constitutional Court show the judicial truth, that the identification of a suspect, "(...) in the judicial practice tends to merit an enhanced probative value, functioning almost as a presumption of guilt of the suspect at least in the investigation phase "(...)" The identification is based on a mnemonic image, so it is associated to a high risk of error, that the legislator recognizes and attempts to safeguard by adopting rigorous procedures. However once installed the doubt on the rigor with which an identification has been made, the judge cannot trust on it anymore, especially because he has no way to verify if all the identification procedures have been respected.. No major legislative changes would be required to give to this evidence a greater degree of security and confidence to the judge. Thus, alongside the systematization of the judge's questions tried to reflect the jurisprudence of the higher courts regarding the same. The final part of this work is constituted by suggestions of legislative changes aiming in essence, to give to the judge an effective control so that he can decide if the person charged of with the crime is guilty or not.
