Abstract

Tendo por base a definição formal de direito de trabalho, enquanto “conjunto de normas e de princípios relacionados com o fenómeno do trabalho subordinado e agrupados em função de uma Ciência jus laboral geográfica e historicamente determinada”, a partir de normas imperativas de direito público e de direito privado com delimitação constitucional, procuramos com este trabalho evidenciar princípios estruturais que permitam ensaiar uma dogmática, em diálogo com a sociedade atual, que obste à alteração dos seus parâmetros por critérios alheios ao direito, ao sabor das conjunturas socioeconómicas que descaracterizem o direito do trabalho enquanto disciplina da proteção dos direitos fundamentais dos sujeitos na relação económica laboral. Este trabalho procura descortinar se os parâmetros laborais essenciais estão suficientemente consolidados e, em face de que critérios estritamente económicos ou políticos, o direito laboral está em condições de reagir autonomamente na regulação de novas realidades, assentando essa reação na prevalência de princípios estruturantes que fizerem eleger ao plano dos direitos fundamentais certas situações do direito jus laboral, princípios que fundamentam a autonomia dogmática do Direito do Trabalho, partindo da análise específica do direito ao trabalho enquanto direito fundamental e do seu alcance, nomeadamente quando se tem de confrontar com outros direitos com proteção constitucional que necessariamente o restringe.

Based on the formal definition of employment law, as the "set of rules and principles related to the subordinate labor phenomenon and grouped according to one Labor Science geographically and historically determined", derived from the mandatory rules of public and private law with constitutional boundaries, we seek with this work to evidence structural principles that enable us to test one dogmatic dialogue with contemporary society, in order to which prevent the modification of its parameters through criteria unrelated to the work law, freely influenced by the socio-economic conjunctures which mischaracterizes the work law as a discipline of protection of the fundamental rights of the individuals under the labor economic relationship. This piece of work tries to unveil whether fundamental labor parameters are sufficiently consolidated and, in response to what criteria - strictly economic or political, labor law is able to react autonomously in the regulation of new realities, being this reaction based on the prevalence of structuring principles, that raises to the plan of fundamental rights certain situations of jus labor law, principles that underlie the dogmatic autonomy of the labor law. Based on a specific analysis of the right to work as a fundamental right and at its range, particularly when we have to confront with other rights, constitutionally protected, which necessarily restricts him.
