Il concordato minore

Abstract

Il contributo ricostruisce in chiave sistematica il concordato minore quale istituto “nuovo” del Codice della crisi, evidenziandone - alla luce della più recente giurisprudenza - la funzione di strumento concordatario calibrato sui debitori “minori” (imprenditore minore, imprenditore agricolo e professionista) e orientato a semplificazione e celerità rispetto alla precedente disciplina del sovraindebitamento. Dopo aver inquadrato il passaggio dalla l. n. 3/2012 al CCII, l’analisi mostra come il concordato minore si innesti nel nucleo di regole della disciplina processuale unitaria, valorizzando la clausola di compatibilità e i relativi riflessi su giurisdizione, competenza e scansioni procedimentali. Ampio spazio è dedicato alle due morfologie della procedura: la proposta c.d. "in continuità" e la versione "liquidatoria", trattata come opzione residuale e aggravata dall’esigenza di risorse esterne a beneficio dei creditori.
