Article 31. The Right to Housing

Abstract

The essay analyzes the right to housing enshrined in the revised European Social Charter – an important international treaty promoted by the Council of Europe to guarantee social rights – with a look also at the protections provided by the International Covenant on Economic, Social and Cultural Rights, the European Convention on Human Rights, and the Charter of Fundamental Rights of the European Union. The essay is included in the extensive Commentary on the European Social Charter, in 8 volumes, written by scholars from the Academic Network on the European Social Charter and Social Rights (ANESC), and pays particular attention not only to doctrine but also to the case law of the European Committee of Social Rights.

Il saggio analizza il diritto all'abitazione sancito dalla Carta sociale europea riveduta – importante trattato internazionale promosso dal Consiglio d'Europa per garantire i diritti sociali – con uno sguardo anche alle tutele previste dal Patto internazionale sui diritti economici, sociali e culturali, dalla Convenzione europea dei diritti dell'uomo e dalla Carta dei diritti fondamentali dell'Unione europea. Il saggio è incluso nell'ampio Commentario sulla Carta sociale europea, in 8 volumi, redatto dagli studiosi della Rete Accademica sulla Carta Sociale Europea e i Diritti Sociali (RACSE-ANESC) e presta particolare attenzione, oltre alla dottrina, alla giurisprudenza del Comitato europeo dei diritti sociali.
