Abstract

Con la pronuncia a commento — concernente il risarcimento del danno non patrimoniale patito dai congiunti per la morte del proprio familiare a causa di un sinistro stradale — la Corte di cassazione è chiamata a stabilire se sia compatibile con l’ordine pubblico, di cui all’art. 16 della legge n. 218/1995, una legge straniera che subordini al requisito della durevole pregressa convivenza la concessione del danno morale da morte del congiunto ai fratelli superstiti escludendo la rilevanza, ai fini risarcitori, della relazione tra nonno e nipoti.

Concerning the compensation for non-pecuniary damage suffered by relatives for the death of their family member in a car accident, the Supreme Cour t of Cassation is asked to establish whether a foreign law (subordinating these damages to a lasting previous cohabitation of the de cuius withhis relatives) is compatible with the public order with reference to ar t. 16 of the law n. 218/1995, excluding this relevance when compensating the lost relationship between grandparents and grandchildren.
