Abstract

O direito ao esquecimento tem origem histórica no terreno das condenações criminais, através do instituto denominado de reabilitação criminal ou simplesmente cancelamento do registro criminal. Mas hoje, fala-se do direito ao esquecimento numa perspectiva mais ampla, como um direito que assume a natureza jurídica de um direito fundamental, cuja base jurídica é advinda do princípio constitucional da dignidade da pessoa humana e dos direitos da vida privada, intimidade, honra e imagem. É exercido tanto na seara pública como no campo do direito privado e estabelece o direito de restringir determinada informação para a sociedade, ou seja, um fato verídico e desabonador ocorrido no passado, com o objetivo de permitir que o indivíduo não sofra para além daquilo que essa informação já lhe causou e pode continuar causando se continuar eternamente disponível. Obviamente o conflito dos direitos fundamentais não é tão recente assim, mas, o direito a privacidade, intimidade, honra e imagem versus a liberdade de expressão, direito de imprensa e o direito informacional ganharam um contexto diferente com a teoria do direito ao esquecimento nessa sociedade líquida. Assim, o intérprete precisa encontrar soluções mais sofisticadas que a simples subsunção, utilizada para a interpretação de normas com estrutura de regras. E a técnica adotada para solução desses problemas é a técnica da ponderação.

The right to forgetfulness has historical origin in the field of criminal convictions, through the so-called criminal rehabilitation institute or simply cancellation of criminal record. But today we speak of the right to forgetfulness in a broader perspective, as a right that assumes the legal nature of a fundamental right whose legal basis is derived from the constitutional principle of the dignity of the human person and the rights of privacy, honor and image. It is exercised both in the public domain and in the field of private law and establishes the right to restrict certain information to society, that is, a truthful and discouraging fact that occurred in the past, with the objective of allowing the individual not to suffer beyond what this information has already caused you and can continue to cause you to remain eternally available. Obviously the conflict of fundamental rights is not so recent, but the right to privacy, intimacy, honor and image versus freedom of expression, press law and information law have gained a different context with the theory of the right to oblivion in this society liquid. Thus, the interpreter must find solutions more sophisticated than the simple subsumption, used for the interpretation of rules with rules structure. And the technique adopted to solve these problems is the technique of weighting.
