Abstract

A presente dissertação apresenta como objetivo central a análise da severidade das medidas aplicadas no sistema de justiça de menores, em concreto no âmbito da jurisdição tutelar educativa. Procura compreender, neste contexto, o papel exercido pelo saber psicológico, sempre que convocada uma intervenção neste domínio, assim como o seu efeito no momento da decisão judicial. Pretende-se, de forma específica, estudar a relação entre a severidade e a psicologização, a severidade e os tipos de ilícitos, assim como a severidade perante a existência, ou ausência, de processo de promoção e proteção. Para tal, recorre à análise documental de 74 processos tutelares educativos em arquivo judicial com decisão proferida entre 2013 e 2017, no Tribunal de Família e Menores de Lisboa, numa amostra composta por 98 jovens, de ambos os sexos. Utiliza-se o Índice de Severidade Penalizadora e Psicologização - Criminalização Secundária – Transgressionalidades e Delinquência Juvenis - ISPP-CS-TDJ, de 2011, num estudo descritivo e correlacional, cujos resultados permitem observar níveis mínimos de severidade e uma psicologização nula.

The current dissertation aims at the analysis of the severity of the measures applied in the juvenile justice system, namely in the educational tutelage context. The main scope is to understand, in this context, the role played by the psychological field, when convened, and its effect in the judicial verdict. Specifically, this study intends to comprise the relationship between severity and psychologization, severity and illicit types and severity considering the existence, or absence, of promotion and protection processes. Data was collected throughout the analysis of 74 educational tutelage documents, related to the trials occurred in Lisbon’s Family and Minor’s Court between 2013 and 2017, and regarding 98 young subjects, male and female. Based on a descriptive and correlational analysis this study uses the Índice de Severidade Penalizadora e Psicologização – Criminalização Secundária – Transgressionalidades e Delinquência Juvenis – IPSS-CS-TDJ (2011). The results suggest minimum levels of severity and a null psychologization.
