Abstract

A pretensão desta dissertação assenta na credibilidade do testemunho de crianças. A confiabilidade do testemunho da criança é algo controverso. Através de uma pesquisa dos conhecimentos científicos da Psicologia e do Direito, será avaliado a precisão do depoimento das crianças em tribunal, explorar o que leva a influenciar esse depoimento, e verificar a sua credibilidade. A Psicologia foi um importante suporte para o Direito, pois conseguiu dar explicações sobre o comportamento verbal e o comportamento não-verbal das crianças. Este contributo foi uma mais-valia no sentido de o depoimento da criança fosse vista como fiável. Este estudo foca-se na Psicologia do Testemunho Infantil, com o intuito de dar a conhecer os pressupostos da confiabilidade dos testemunhos infantis. Procura-se descodificar a forma como o testemunho infantil é sobrevalorizado pela justiça, as vulnerabilidades e a pressão que as crianças estão sujeitas perante este contexto judicial. Perante algumas situações, tais como, os maus-tratos, o bullying e a violência sexual, saber como é que a criança se sente, psicologicamente, ao ter que depor. Pretende-se averiguar os pressupostos que se baseiam na credibilização do testemunho infantil, e focar no tema de abuso sexual em crianças.

The intention of this thesis is based on the credibility of the testimony of children. The child's testimony reliability is something controversial. Through a survey of scientific knowledge of psychology and law, the accuracy of the testimony of children in court will be evaluated, explore what it takes to influence this statement, and check their credibility. Psychology was an important support for the law, because it could give explanations of verbal behavior and nonverbal behavior of children. This contribution was an advantage in the sense of the child's testimony was seen as unreliable. This study focuses on Psychology of Child Witness, in order to make known the conditions of the reliability of children's testimony. Wanted decode how the child witness is overvalued for justice, vulnerabilities and the pressure that children are subject before this judicial context. Under certain situations, such as ill-treatment, bullying and sexual violence, to know how the child feels psychologically by having to testify. It is intended to determine the assumptions that are based on the credibility of child testimony, and focus on the sexual abuse issue in children.
