Abstract

A presente dissertação tem como objetivo estudar a temática da credibilidade do testemunho de crianças e jovens menores de idade. Os depoimentos efetuados por sujeitos de idades precoces geram controvérsia, pois, se por um lado existe uma tendência para lhes atribuir pouca confiabilidade e considerá-los como testemunhos inseguros e vacilantes, pelo outro existe o mito de que as crianças não mentem. Alguns autores referem ainda a falta de sinceridade das crianças e dos jovens, que poderá ser atribuída ao receio de um castigo contra si mesmo ou de uma punição a um familiar ou pessoa significativa, pelo que há que ter presente a possibilidade de mentira defensiva. Um falso testemunho poderá também ser induzido pela pressão de uma sugestão, por declarar como verdadeira uma ocorrência não real, baseada em falsas memórias, por sugestão, através de perguntas tendenciosas, pelo embaraço em narrar factos constrangedores ou ainda pela pouca capacidade em distinguir a verdade e a mentira, devendo partir-se do pressuposto que nem todos têm o mesmo grau de desenvolvimento intelectual, dependendo este do ambiente familiar, da educação, da socialização e de toda uma série de características pessoais que por certo influirão em determinado momento na veracidade do testemunho.

This thesis aimed to study the issue of credibility of the testimony of children and youth under age. The statements made by the subjects of earlier ages are controversial because on one hand there is a tendency to attribute their poor reliability and consider them to be insecure and vacillating testimony, on the other there is the myth that children do not lie. Some authors mention the lack of sincerity of children and young people can be attributed to fear of retribution against himself or a punishment to a family member or significant person, so it should be noted the possibility of defensive lie. A false testimony may also be induced by the pressure of a suggestion by stating as true not a real occurrence, based on false memories by suggestion through leading questions, the awkward embarrassment narrate the facts or little ability to distinguish the truth from lie, should be based on the assumption that not everyone has the same level of intellectual development, this depending on the family environment, education, socialization and a whole host of personal characteristics which certainly will affect any given time in the veracity of the testimony.
