Abstract

Falar sobre motivações ajurídicas do sentenciar implica que se compreenda uma série de realidades que, ao longo dos séculos, caminharam paralelamente, não obstante nem sempre estarem interligadas. Psicologia, Direito e Justiça deveriam ser tidos como um todo, como complementos de uma mesma realidade - o Homem e o seu comportamento. Não basta a criação legislativa e a aplicação de penas se não se compreenderem os motivos associados à transgressão, se não forem tomadas medidas que corrijam, eduquem e enquadrem a realidade social ao contexto do momento. É fundamental uma sociedade legislada, segura, mas mais que isso é premente uma sociedade reeducada onde se compreendam todos os atores sociais, transgressores, vítimas, testemunhas, aplicadores do Direito, técnicos de polícia e de reinserção, legisladores e até os técnicos forenses. É fundamental uma sociedade do homem, com o homem, para a compreensão do mesmo. Até lá, em que campos se torna fundamental a Psicologia e como poderá esta Ciência atuar judicialmente, descartando enviesamentos, estereótipos, preconceitos, juízos desprovidos das internalidades e invisibilidades judiciais é o que nos conduz neste estudo. Perceber quem são os atores sociais e como agem, porque agem, sob que preâmbulo é ao que se dedicam as páginas que se seguem, é ao que se dedica a Psicologia Forense, a Psicologia do Testemunho e é no fundo o que condiciona e motiva o julgador.

Talk about the sentencing non judicial motivations implies that it is understood a number of things that, for centuries, walked alongside, despite not always being interconnected. Psychology, Law and Justice should be taken as a whole, as complements of the same reality - humans and their behavior. Is not enough legislative creation and the application of penalties if they do not understand the reasons associated with transgression, if measures to correct, educate and frame the social reality to the context of the moment are not taken. It is imperative that a legislated, safe society, but more than that is pressing a society where re-educated to understand all social actors, offenders, victims, witnesses, law enforcers, police technicians and rehabilitation, legislators and even forensic technicians. It is fundamentally a society of man with man, for its understanding. Until then, in fields that becomes critical Psychology and how this Science can act judicially, discarding biases, stereotypes, devoid of judgments and judicial internalities invisibility is what drives us in our inquiry. Realize who the social actors and how they act, why they act, under which the preamble is engaged in the following pages, it is dedicated to Forensic Psychology, the Psychology of Testimony and is ultimately what determines and motivates the judge.
