O papel das vítimas no Tribunal Penal Internacional
The present Dissertation aims to address the development of International Criminal Law concerning the rights of victims. By resorting to document analysis, the historical aspects related to the evolution of the institute of international criminal responsibility are first approached. From there, the five ages of the development of international criminal responsibility are discussed: (1) state criminal jurisdictions, second phase (2) the International Military Tribunals of Nuremberg and Tokyo (3) the political and doctrinal path of substantive formulation of new international crimes, (4) the ad-hoc international tribunals for the former Yugoslavia and Rwanda, and (5) the Rome Statute and the International Criminal Court. Following this, the fundamental features of international criminal responsibility are highlighted, as well as issues related to the evolution of the role of victims before the International Criminal Court. A presente Dissertação pretende abordar o desenvolvimento do Direito Internacional Penal no que concerne aos direitos das vítimas. Recorrendo a análise documental abordam-se os aspectos históricos relacionados com a evolução do instituto da responsabilidade penal internacional, primeiramente. A partir daí, as cinco eras do desenvolvimento da responsabilidade penal internacional, (1) as jurisdições estaduais penais, segunda era (2) os Tribunais Militares Internacionais de Nuremberga e de Tóquio (3) o caminho político e doutrinário da formulação substantiva de novos crimes internacionais, (4) os tribunais internacionais ad-hoc para a ex-Jugoslávia e para o Ruanda e (5) o Estatuto de Roma e o Tribunal Penal Internacional. Após o que se evidenciam os traços fundamentais da responsabilidade penal internacional, bem como questões atinentes à evolução do papel das vítimas perante Tribunal Penal Internacional.
