Acidentes de trabalho em teletrabalho

Abstract

Em termos gerais, o acidente de trabalho corresponde ao evento que ocorre no local e tempo de trabalho e que produz direta ou indiretamente lesão corporal, perturbação funcional ou doença de que resulte redução na capacidade de trabalho ou de ganho ou a morte. O teletrabalho consiste na prestação de trabalho através do recurso a tecnologias de informação e comunicação em local não determinado pelo empregador. A problemática dos acidentes de trabalho em teletrabalho não é nova. Contudo, o teletrabalho ganhou maior expressão com a pandemia provocada pela COVID-19. E, novas e velhas questões foram colocadas em evidência. O trabalhador que presta a sua atividade em regime de teletrabalho subordinado, no seu domicílio não está imune à ocorrência de acidentes de trabalho. Assim, torna-se evidente a necessidade de contribuir para a interpretação do que deve ser entendido como local e tempo de trabalho, nexo de causalidade e de perquirir se estes elementos devem permanecer como elementos necessários à qualificação de um acidente de trabalho sofrido pelo teletrabalhador no seu domicílio. O nosso estudo tem por base legal o Regime de Reparação de Acidentes de Trabalho e de Doenças Profissionais, o Código do Trabalho e respetivas interpretações jurisprudenciais e doutrinais.

In general terms, a work accident is an event that occurs at the place and time of work and which directly or indirectly causes body injury, functional disorder or illness resulting in a reduction in working or earning capacity or death. Teleworking is the provision of work through the use of information and communication technologies at a location not determined by the employer. The issue of work accidents in telework is not new. However, teleworking has gained greater expression with the pandemic caused by COVID-19. And new and old issues were put in evidence. Workers who work in a subordinate teleworking regime at home are not immune to accidents at work. Thus, there is a clear need to contribute to the interpretation of what should be understood as the place and time of work, the nexus of causality and whether these elements should remain as necessary elements for the qualification of an accident at work suffered by the teleworker at home. Our study is legally based on the Work Accidents and Illness Repairing Scheme, the Labour Code and respective jurisprudence and doctrine interpretation.
