Abstract

O crime de violação sexual é um dos crimes mais lesivos no ordenamento jurídico-penal português, cujas consequências são graves. O consecutivo aumento destes processos-crime apela ao conhecimento sobre a atuação da justiça penal na dissuasão deste tipo de criminalidade. O presente estudo exploratório almeja aprofundar o conhecimento sobre a atuação do sistema punitivo no crime de violação, aferindo o índice de severidade penalizadora e psicologização destes processos-crime, analisando se a Psicologia contribuiu para a tomada de decisão judicial e em que medida influenciou a severidade da pena. Pretendeu-se, também, recolher informação juspsicológica sobre alegados agressores e vítimas. Para tal, recorreu-se ao Índice de Severidade Penalizadora e Psicologização – Criminalização Secundária (ISPP–CS; Poiares, 2009), sendo a amostra constituída por 40 processos-crime do Tribunal Judicial da Comarca de Lisboa – Varas Criminais, englobando 45 decisões judiciais. Os resultados demonstram uma variabilidade na tipologia da sanção e severidade penalizadora, verificando-se um índice de severidade médio, demonstrando que os decisores não aplicam uma pena nem demasiado branda nem demasiado severa. O grau de psicologização revelou ser mínimo, demonstrando uma fraca permeabilização do saber psicológico no território judicial no âmbito de processos crime de violação. Não obstante, verificou-se que a Psicologia influencia a severidade da pena, agravando-a.

The sexual rape crime is one of the most damaging crimes in the Portuguese penal system, whose consequences are severe. The consecutive increase of these criminal proceedings calls for knowledge about the role of criminal justice in the deterring of this crime. This exploratory study aims to deepen the knowledge about the performance of the punitive system in rape crime, investigating the severity of the penalties and the degree to which Psychology is present in these criminal proceedings, analysing whether contributed to judicial decision-making and if influenced the sentence’s severity. It was also pretended collecting juspsychological information about alleged aggressors and victims. For this purpose, Índice de Severidade Penalizadora e Psicologização – Criminalização Secundária (ISPP–CS; Poiares, 2009) was the tool chosen. The convenience sample consists of 40 crime proceedings collected from Tribunal Judicial da Comarca de Lisboa – Varas Criminais, gathering 45 judicial decisions. The results show variable drifts in sanction and punitive severity, verifying an average severity index, showing that judges do not apply a penalty that is neither too lenient nor too severe. The psychologization degree is minimum, showing a low permeability of psychological knowledge when dealing with rape criminal proceedings. Nevertheless, Psychology influences the sentence’s severity by aggravating it
