En los estudios sobre el Barroco un aspecto que habitualmente se obvia es el Derecho de esta época, pese a que es indudable la existencia de una jurisprudencia del Barroco. Pretendemos analizar el Derecho de este tiempo, que se encuadra en la corriente doctrinal del mos italicus tardío, cuya influencia causó que la jurisprudencia de la época tuviera unas características propias. Prestaremos atención a la dicotomía a la que se enfrentaban los juristas de utilizar el latín o el castellano en sus escritos. Y destacaremos otras características, tales como la utilización excesiva de autoridades, primando el argumento de autoridad como técnica empleada para argüir, hasta provocar que los textos jurídicos se redactaran utilizando una selva y enjambre de citas de juristas y tratados. Se emplean como argumentos todo tipo de autoridades, tales como citas bíblicas, patrística o literarias, al tiempo que abundan la utilización de paráfrasis verbales, metáforas y otros recursos literarios, típicos de la época. In studies on the Baroque, one aspect that is usually ignored is the law of this period, despite the undoubted existence of Baroque jurisprudence. We intend to analyze the law of this time, which is framed in the doctrinal current of the late mos italicus, whose influence caused the jurisprudence of the period to have its own characteristics. We will pay attention to the dichotomy faced by the jurists of using Latin or Spanish in their writings. And we will highlight other characteristics, such as the excessive use of authorities, prioritizing the argument of authority as a technique used to argue, to the point that legal texts were written using a jungle and swarm of quotes from jurists and treatises. All kinds of authorities are used as arguments, such as biblical, patristic or literary quotations, while verbal paraphrases, metaphors and other literary resources, typical of the time, abound.
