Tipicidade penal e o princípio da insignificância

Abstract

A presente investigação busca compreender e analisar o princípio da insignificância e a consequência de seu reconhecimento como causa excludente da responsabilidade penal. Partindo, portanto, da análise do conceito em si, seus precedentes históricos e sobretudo com os fundamentos constitucionais e político-criminais que o erigem à condição de princípio de direito penal, busca-se, em um segundo momento, investigar o conceito e evolução da tipicidade penal até o momento dogmático em que passa a abrigar a concepção de bem jurídico e, assim, ostentar um caráter material, juízo absolutamente necessário para a afirmação da eventual insignificância de determinada conduta. Analisada essa relação, passa-se a observar como o princípio da insignificância funciona, de fato, como excludente da responsabilidade penal, enfrentando diversos posicionamentos doutrinários que não o relacionam com a tipicidade, além dos demais argumentos que refutam a sua vigência. Por fim, através de uma análise de direito comparado integrantes do sistema europeu e interamericano de proteção de direitos humanos, observou-se que o princípio teve uma grande acolhida nos ordenamentos jurídicos através de mecanismos processuais de oportunidade da ação penal, o que explica, em parte, um maior ou menor desenvolvimento do problema à luz da dogmática penal, sem, contudo, deixar de ser apreciado como princípio de direito penal material.

This investigation aims to understand and analyze the petty offense phenomenon and the insignificance principle as a cause that excludes criminal liability. Starting, therefore, from the analysis of the concept itself, its historical antecedents and the constitutional and political-criminal foundations that establish it as a principle of criminal law, the goal, in a second moment, is to investigate the concept and evolution of legal definition of crime until the dogmatic moment in which it begins to encompass the concept of protected legal interest, in a material perspective, a judgment that is absolutely necessary for the affirmation of the principle. It was observed how the principle, in fact, exclude criminal liability, with several doctrinal positions that do not relate it to the legal definition of crime, in addition to other arguments that refute its validity. Finally, through an analysis of comparative legal order of members of the European and Inter-American system of human rights protection, it was observed that the principle had a large impact on legal systems through procedural mechanisms of opportunity on criminal proceedings, which explains, in part, a greater or lesser discussion of the problem on criminal dogmatics, without, however, ceasing to be regarded as a principle of criminal law.
