Abstract

O conceito de prisão é transversal a toda a história da humanidade; sempre esteve presente na sociedade. Contudo, a pena de prisão, como a conhecemos hoje, só surge no final do século XVIII, início do século XIX. Durante séculos, a punição dos criminosos assentava no suplício e no abominável teatro de castigos corporais. Considerando a sua origem sombria, a modernização do sistema foi bastante tardia, e, atualmente, ainda existe uma grande necessidade de reforma na maioria das instituições prisionais. O presente Projeto Final de Mestrado (PFM) procura compreender e contribuir para a reforma do sistema prisional português, requerendo alterar a forma como os estabelecimentos penitenciários acolhem e lidam com os reclusos. Pretende-se elaborar um projeto resultante da reflexão teórica, explorando o desenvolvimento de um equipamento prisional que acolha e reabilite os reclusos. O trabalho ambiciona criar uma prisão que facilite as duas contradições mutuamente dependentes: o objetivo de proteger a sociedade de atos criminosos e o propósito de garantir que o recluso tenha a oportunidade de retornar à sociedade como um futuro cidadão cumpridor da lei. A construção de um relacionamento entre presos e funcionários constitui uma parte importante dos dois processos de reabilitação e garantia de segurança. Os detidos estão condenados, mas não estão privados dos seus direitos como cidadãos em relação à educação, saúde, trabalho, religião e serviços sociais. Por consequência, realiza-se uma análise do contexto prisional, expondo como a conceção das prisões descendem de diversas tipologias, cujo intuito incidia em assegurar a vigilância e a segurança. No seguimento, investiga-se a influência da arquitetura na atmosfera do estabelecimento prisional e como esta interfere na reabilitação do prisioneiro.

The concept of imprisonment is common throughout history; it has always existed in society. However, imprisonment as we know it today has only been around since late 18th century and the beginning of the 19th century. For centuries, the punishment of criminals relied on the ordeal of corporal punishment. Considering its dark origin, the modernization of this system was long overdue. Today we still see a great need for reform in most correctional facilities. This paper seeks to understand and contribute to the reform of the Portuguese correctional system aiming to alter the way correctional facilities take in and lead with convicts. It is intended to elaborate a project resulting from theoretical reflection, exploring the development of a prison equipment that welcomes and rehabilitates prisoners. The work aims to create a prison that facilitates the two co-dependen contradictions: protecting society from criminals while also guaranteeing the convict has the possibility to return to society as a law-abiding citizen. Building a good relationship between convicts and prison staff is also very important to both the rehabilitation process and guaranteeing safety. Prisoners may be convicted but they should not be deprived of their fundamental rights as citizens — education, healthcare, work, religion and social services. Consequently, an analysis of the prison context is carried out, exposing how the design of prisons descends from various typologies, whose purpose was to ensure surveillance and security. In the follow-up, the influence of architecture on the atmosphere of the prison is investigated and how it interferes in the rehabilitation of the prisoner.
