Abstract

Nesta pesquisa se pretende analisar a implementação de políticas públicas pelo Poder Judiciário por meio do que tem sido atualmente chamado, pela doutrina brasileira, de Processo Estrutural. O objetivo é demonstrar que, apesar da proposta trazer mais participação e transparência aos processos judiciais, o Processo Estrutural, caso seja eficaz na concretização dos direitos a que se propõe a efetivar, implicaria em ativismo judicial na sua dimensão negativa. Este estudo investiga, para tanto, como o Processo Estrutural transforma o Poder Judiciário em agente central na formulação de políticas públicas, função originalmente atribuída ao Legislativo e ao Executivo pela Constituição. E como tal protagonismo, embora frequentemente justificado pela necessidade de efetivação de direitos fundamentais, pode resultar em ingerência judicial em temas complexos, ultrapassando os limites da função jurisdicional. Por fim, a investigação ora empreendida examina as consequências desse ativismo judicial para a ordem constitucional, com especial atenção à legitimidade democrática das decisões judiciais. Discutindo os impactos dessa atuação sobre o princípio da separação de poderes e o risco de enfraquecimento das instâncias deliberativas, instâncias estas as mais aptas a resolver questões de interesse público por meio de um processo político mais plural e representativo.

This research aims to analyze the implementation of public policies by the Judiciary through what has currently been referred to, in Brazilian legal scholarship, as Structural Litigation. The main purpose is to demonstrate that although the proposal enhances participation and transparency in judicial processes, Structural Litigation, if effective in achieving the rights it seeks to enforce, implies judicial activism in its negative dimension. The study further investigates how Structural Litigation transforms the Judiciary into a central agent in the formulation of public policies, a function originally attributed to the Legislative and Executive branches. It also examines how this protagonism, although often justified by the need to enforce fundamental rights, may lead to judicial interference in complex matters, exceeding the boundaries of the judicial function. Finally, this research examines the consequences of judicial activism for the constitutional order, with special attention to the democratic legitimacy of judicial decisions.It discusses the impact of this activism on the principle of separation of powers and the risk of weakening deliberative bodies, which are better suited to resolve public interest issues through a more plural and representative political process.
