Abstract

Esta tese tem como objetivo principal investigar o enquadramento das estruturas temporárias na Administração Pública, com um foco específico nas Estruturas de Missão em Portugal. Inicialmente, é realizada uma análise abrangente da organização administrativa do Estado português, explorando os princípios gerais e a estrutura da administração direta do Estado. Em seguida, aprofunda-se a análise através do enquadramento das Estruturas de Missão como uma forma de organização na Administração Pública, considerando a continuidade do serviço público, a temporariedade de determinadas funções e a gestão por projetos como elementos-chave para compreender o propósito e a eficácia dessas estruturas. Uma nota histórica é apresentada para contextualizar o surgimento e a evolução das Estruturas de Missão ao longo do tempo, destacando exemplos significativos e comparando-as com outras formas de organização temporária, como comissões e grupos de trabalho. Além disso, um estudo de caso detalhado da Estrutura de Missão "Recuperar Portugal" é realizado, examinando não apenas a sua função como entidade adjudicante e empregadora, mas também o impacto das suas atividades no contexto mais amplo da Administração Pública portuguesa. Procura-se com o presente trabalho identificar o papel das Estruturas de Missão num contexto mais vasto da tipologia das organizações administrativas, reportando em que condições e sob que pressupostos é admissível e adequado o recurso a estas estruturas. Ao abordar esses tópicos, esta tese visa contribuir para uma melhor compreensão do funcionamento e da importância das Estruturas de Missão na administração pública portuguesa. Através de uma análise detalhada e uma investigação aprofundada, procuro fornecer insights que possam informar políticas públicas, práticas de gestão e futuras pesquisas académicas nesta área.

The main aim of this thesis is to investigate temporary structures in public administration, with a specific focus on Mission Structures in Portugal. Initially, a comprehensive analysis of the administrative organization of the Portuguese State is carried out, exploring the general principles and structure of the State's direct administration. Then, I delve into the framework of Mission Structures as a form of organization in public administration, considering the continuity of public service, the temporariness of certain functions and project-based management as key elements in understanding the purpose and effectiveness of these structures. A historical note is presented to contextualize the emergence and evolution of Mission Structures over time, highlighting significant examples and comparing them with other forms of temporary organization, such as commissions and working groups. In addition, a detailed case study of the "Recuperar Portugal" Mission Structure is carried out, examining not only its role as a contracting authority and employer, but also the impact of its activities in the wider context of Portuguese public administration. The aim of this work is to identify the role of the Mission Structures in the broader context of the typology of administrative organizations, reporting under what conditions and assumptions the use of these structures is admissible and appropriate. By addressing these topics, this thesis aims to contribute to a better understanding of the functioning and importance of Mission Structures in the Portuguese public administration. Through detailed analysis and in-depth research, I aim to provide insights that can inform public policy, management practices and future academic research in this area.
