Criado em 1999 o sistema de promoção e proteção tem como objetivo garantir a proteção dos direitos e interesses das crianças e jovens em situação de perigo, promovendo o seu desenvolvimento integral. É justamente nesse sistema que se enquadra, enquanto medida de colocação, o acolhimento familiar. Aquando da aplicação desta medida a criança ou jovem são retirados à sua família de origem que, durante o período de execução da medida deverá ser acompanhada por técnicos que a auxiliarão a reunir as condições adequadas para o retorno daqueles. Durante esse lapso de tempo aqueloutros estarão sob o cuidado de uma família de acolhimento que lhes proporcionará um ambiente familiar estável e seguro para o seu desenvolvimento, garantindo o respeito pelos seus direitos e promovendo o seu bem-estar físico, psicológico e emocional. Embora esta medida vise contribuir para a desinstitucionalização das crianças e jovens, tal não se tem verificado com a intensidade que se esperava, sendo que o principal motivo indicado se prende com a escassez de famílias de acolhimento em bolsa. Assumindo a veracidade de tal justificação, é óbvia e pouco exigente a solução para tal obstáculo: a divulgação da medida. Além desta, são várias as fragilidades passíveis de ser associadas à regulamentação jurídica da medida, desde a inexistência de uma modalidade de acolhimento familiar especializado, à impossibilidade de as famílias de acolhimento adotarem a criança ou jovem acolhidos. É tendo em mente todas as questões mencionadas, bem como aquela que é a regulamentação jurídica da medida em países como os EUA ou Espanha, que se elencam as alterações que devem ser levadas a cabo a fim de se constituir um novo e melhorado modelo de acolhimento familiar.

Created in 1999, the promotion and protection system aims to ensure the protection of the rights and interests of children and young people in situations of danger, by promoting their integral development. It is precisely within this system that foster care, as a placement measure, is included. When this provision is applied, the child or juveniles removed from their family of origin and during the period of execution of the measure, the family is followed by technicians who will assist them in gathering the appropriate conditions for their return. During this period, they will be under the care of their foster family, who will provide a stable and secure family environment for their development, ensuring respect for their rights and promoting their physical, psychological, and emotional well-being. Although this measure contributes to the deinstitutionalization of children and young people, that it has not been as noticeable as expected due to the scarcity of available foster families. Assuming the veracity of this justification, the solution is clear and straightforward: the dissemination of the measure. Additionally, there are several weaknesses that can be associated with the legal regulation of the measure, from the lack of a specialized form of foster care to the inability of foster families to adopt the children or juvenile in their care. With these considerations in mind, as well as the legal regulation of the measure in countries such as the USA or Spain, the changes that need to be implemented to develop a new and improved foster care model are mentioned.
