Abstract

As directivas comunitárias sobre seguros exigem que todas as empresas de seguros disponham de provisões técnicas, incluindo provisões matemáticas, suficientes para fazer face aos compromissos assumidos. Estas provisões devem estar devidamente representadas por activos equivalentes, de acordo com o tipo de operações que as empresas efectuam e de modo a garantir, além da rendibilidade, a segurança e a liquidez desses investimentos. Além das provisões técnicas, as empresas de seguros devem dispor de uma margem de solvência e de um fundo de garantia mínimo. Todas as empresas de seguros, enquanto empresas consideradas individualmente, estão sujeitas à supervisão pelas entidades competentes do Estado—membro de origem, de acordo com as normas estabelecidas por esse Estado, tomando em consideração o disposto nas directivas comunitárias. A essas entidades compete assegurar a supervisão da solidez financeira das empresas de seguros, nomeadamente no que se refere à constituição das provisões técnicas e à sua representação por activos congruentes e ainda à situação de solvência das empresa.
