As figuras do dano biológico e do dano existencial surgem, sobretudo, através de via jurisprudencial, como resposta às necessidades do indivíduo que, devido a um determinado evento, sofre uma afetação negativa na sua esfera pessoal, a qual necessita ser colmatada. Apesar das divergências que marcam a concretização destes danos e sua consequente aplicação prática, revelam-se fundamentais para assegurar, na medida do possível, a sua ressarcibilidade e, consequentemente, reforçar a proteção dos direitos de personalidade. O dano biológico decorre da lesão que afeta a integridade físico-psíquica do indivíduo, causando consequências permanentes ou temporárias na sua capacidade funcional. O dano existencial, por sua vez, decorre da perturbação significativa no modo de vida da pessoa, privando-a de realizar atividades essenciais à sua felicidade, desenvolvimento pessoal e social. Assim, a reparação desses danos representa uma evolução na forma da tutela da dignidade da pessoa que, mesmo quando seja no âmbito da natureza imaterial, merece proteção jurídica. No entanto, alguns aspetos de cada figura, como o reconhecimento e a autonomia destes danos, enfrentam diversos desafios, entre os quais se destacam os critérios para a sua determinação, os limites, a prova e os parâmetros adequados para a indemnização. Nestes termos, pretende-se o desenvolvimento destas figuras, desde a sua génese, o seu âmbito, autonomia, explorando as divergências doutrinárias e ilustrando a importância adoção de novos danos e adaptabilidade da responsabilidade civil no direito português.

The figure of biological damage and existential damage arises, above all, through jurisprudence, as a response to the needs of the individual who, due to a certain event, sees a negative impact on his/her sphere, which must be remedied. Despite the differences that mark the implementation of these damages and their consequent practical application, they are fundamental to ensuring, to the extent possible, their compensation and, consequently, reinforcing the protection of personality rights. Biological damage results from an injury that affects the individual's physical and psychological integrity, causing permanent or temporary consequences to their functional capacity. Existential damage, in turn, results from the significant disruption to a person's way of life, depriving them of carrying out activities essential to their happiness, personal and social development. The reparation of such damage represents an evolution in the form of protection of the dignity of the person who, even when it is in the scope of an immaterial nature, deserves legal protection. However, some aspects of each figure, such as the recognition and autonomy of these damages, face several challenges, among which the criteria for their determination, the limits, the evidence, and the appropriate parameters for compensation stand out. In these terms, the aim is to develop these figures, from their genesis, their scope, autonomy, exploring doctrinal divergences and illustrating the importance of adopting new damages and adaptability of civil liability in Portuguese law.
