Abstract

O presente trabalho tem por escopo abordar a infiltração de agentes policiais na internet no combate ao crime de pornografia infantil, ultrapassando os conceitos de Dark Web e seus buscadores anônimos, para mostrar o que hoje é a nova face dos ilícitos envolvendo a exposição digital do abuso de crianças e adolescentes na Rede . Para isso, abordamos a moderna realidade criminológica para se chegar ao ponto em que a pornografia infantil migra dos serviços abertos para as redes P2P e finalmente para os hiddens services nos mais ocultos setores da Depp Web, onde a atuação infiltrada se apresenta como a principal ferramenta na colheita da prova e materialidade do delito. A utilização de agentes encobertos e infiltrados, como método oculto de obtenção de prova, deve ser precedida de rigorosa observância dos princípios constitucionais que visam proteger a intimidade e a privacidade do investigado, além da subsunção aos seus pressupostos legais de validação. Observar se á, ainda, o âmbito de atuação dos agentes policiais, sejam nos canais abertos e fechados de comunicação como limites da atuação policial e a necessidade de proceder à separação do agente encoberto virtual do agente infiltrado virtual , bem como o engano e o consentimento viciado do investigado, fruto de confiança artificialmente induzida, como gerador da necessária autorização judicial para se garantir a validade da prova a ser levada ao juízo criminal.

The present work aims to address the infiltration of police agents on the internet in the fight against the crime of child pornography, going beyond the concepts of the Dark Web and its anonymous search engines, to show what today is the new face of il licit acts involving the digital exposure of abuse of children and adolescents in the Network. For this, we approach the modern criminological reality to reach the point where child pornography migrates from open services to P2P networks and finally to hid den services in the most hidden sectors of the Depp Web, where the infiltrated performance presents itself as the main tool in the collection of evidence and materiality of the crime. The use of undercover agents, as a hidden method of obtaining evidence, must be preceded by strict observance of constitutional principles that aim to protect the intimacy and privacy of the investigated, in addition to subsuming their legal validation assumptions. It will also be observed the scope of action of police agents, whether in open and closed channels of communication as limits of police action and the need to proceed with the separation of the forms of virtual undercover agent, as well as the deception and the biased consent of the investigated, the result of artifi cially induced trust, as a generator of the necessary judicial authorization to guarantee the validity of the evidence to be taken to the criminal court.
