Abstract

Neste trabalho se buscou analisar a influência do fenômeno do populismo com ênfase ao funcionamento dos sistemas de justiça brasileiro e português. Se observou que exercem , frente aos demais poderes (órgãos de soberania), interferências, seja através do ativismo judicial, seja por meio da pressão popular e de outros mecanismos que acabam por modificar, se é que assim se pode dizer, o olhar do julgador. A pesquisa, após extensa investigação teórica, dedutiva descritiva, concentrou-se em demonstrar alguns julgados, tidos como paradigmáticos, mais recentemente no Brasil e em Portugal, em que a temática da suposta influência, de quebra nos traz diferentes conclusões, como exemplo mais marcante a de que a Teoria da Separação de Poderes foi ventilada como vulnerável e assim, diante de vários fatores, modificada, seja pelos autores que nela se encontram envolvidos, seja pela crítica doutrinária. Para tanto, a contextualização do tema centrou- se no levantamento histórico sobre primeiramente o que viria a ser o fenômeno do populismo, sua contextualização dentro da ressignificação desta Teoria, sua relação com os ditames da Democracia, para que assim, pudéssemos demonstrar a continuidade do intento da mantença do Estado Democrático de Direito. Na sequência, demonstra-se a estrutura dos Sistemas de Justiça, a distribuição de competências entre os seus componentes, até que cheguemos aos órgãos de soberania tanto no Brasil como em Portugal, bem como os aspectos considerados relevantes sobre o controle de constitucionalidade exercido. A sobreposição do Poder Judiciário, em que pese alguns excessos, é tratada como necessidade decorrente da crise de representatividade da classe política e da dissociação do que está previsto nas constituições, como exemplo, a falha na execução das políticas públicas e no respeito aos direitos fundamentais.

This work sought to analyze the influence of the phenomenon of populism with emphasis on the functioning of the Brazilian and Portuguese justice systems. It was observed that they exert interference against other powers (sovereignty bodies), either through judicial activism, or through popular pressure and other mechanisms that end up modifying, if we can say so, the look of the judge. The research, after extensive theoretical, deductive and descriptive investigation, focused on demonstrating some judgments, considered paradigmatic, more recently in Brazil and Portugal, in which the theme of the alleged influence, of breaking brings us different conclusions, as the most striking example. that the Theory of Separation of Powers was ventilated as vulnerable and thus, in the face of several factors, modified, either by the authors involved in it, or by doctrinal criticism. In order to do so, the contextualization of the theme focused on the historical survey on what would become the phenomenon of populism, its contextualization within the resignification of this Theory, its relationship with the dictates of Democracy, so that we could demonstrate the continuity of the attempt to maintain the democratic rule of law. Subsequently, the structure of the Justice Systems, the distribution of competences among their components, until we reach the sovereign bodies in both Brazil and Portugal, as well as the aspects considered relevant about the exercise of constitutional control are shown. The overlapping of the Judiciary, despite some excesses, is treated as a necessity arising from the crisis of representativeness of the political class and the dissociation of what is provided for in the constitutions, as an example, the failure to implement public policies and respect for fundamental rights.
