O trabalho investiga o papel da justiça constitucional na defesa da democracia, no contexto do constitucionalismo pós-moderno. A democracia não se encontra absolutamente protegida em face de invasões totalitárias, bem como não há imunizantes perfeitamente capazes de estancar ataques de ideologias bárbaras e anticonstitucionais. Assim, cabe à jurisdição constitucional a interpretação e concretização da Constituição, dada a função de guardiã do sistema constitucional, tanto a nível interno, comunitário e internacional. Nesse mister, quando da decisão de casos concretos, o juízo constitucional deve orientar-se pela compatibilização das conquistas medulares do constitucionalismo: estado de direito, direitos fundamentais e democracia. Na regulação de cidadãos, movimentos, partidos políticos e entidades públicas, a justiça constitucional tem o dever de garantir o funcionamento harmônico e interdependente das funções do estado, de acordo com a tripartição de funções. Então, o papel da justiça constitucional é avaliar o passado, em processos judiciais que respeitem os direitos de liberdade e o pluralismo político; a administração cuida do presente com a criação e implantação de políticas e serviços públicos, em especial para potencializar o desenvolvimento econômico, de acordo com a eficiência e boas práticas administrativas; por fim, o legislativo volta-se ao futuro, regulando comportamentos abstratos e genéricos, em favor da realização do bem comum. Dessa forma, a efetiva defesa da democracia é o exercício conjunto, eficaz e eficiente de todas as funções do estado, inclusive da jurisdição constitucional, que deve notabilizar-se pela autocontenção. Por fim, em casos extremos, em nome da defesa da democracia, a justiça constitucional deve lançar mão de processos criminas, sem olvidar dos direitos a anterioridade da lei penal, do juiz natural, da ampla defesa, do contraditório e da individualização das condutas e das penas.

Democracy is not absolutely protected in the face of totalitarian invasions, nor are there immunizations perfectly capable of stopping attacks from barbaric and anti-constitutional ideologies. Therefore, it is up to the constitutional jurisdiction to interpret and concretize the Constitution, given its role as guardian of the constitutional system, both domestically, in the regional and internationally courts. In this regard, when deciding concrete cases, the constitutional judge must be guided by the compatibility of the core achievements of constitutionalism: the rule of law, fundamental rights and democracy. In regulating citizens, movements, political parties and public entities, constitutional justice has to guarantee the harmonious and interdependent functioning of the functions of the state, in accordance with the tripartite division of functions. Therefore, the role of constitutional justice is to evaluate the past, in judicial processes that respect the rights of freedom and political pluralism; the administration takes care of the present with the creation and implementation of public policies and services in accordance with efficiency and good administrative practices; finally, the legislature turns to the future, regulating abstract and generic behavior, in favor of achieving the common good. In this way, the effective defense of democracy is the joint, effective and efficient exercise of all the functions of the state, including constitutional jurisdiction, which must be noted for its self-restraint. Finally, in extreme cases, in the name of defending democracy, constitutional justice must resort to criminal proceedings, without forgetting the fundamental rights, like to the anteriority of the criminal law, the natural judge, a broad defense, an adversarial proceeding and the individualization of conduct and penalties.
