Tribunais penais internacionais : os direitos da mulher nos conflitos armados

Abstract

Os actos de violência sexual e/ou física contra as mulheres têm estado, desde sempre, presentes nos conflitos armados. Durante séculos foram ignorados e tolerados, contudo, a partir do século XIX o paradigma começou a mudar. No século XX, com a evolução do Direito Internacional Humanitário, dão-se os primeiros passos no sentido dos actos de violência sexual, ocorridos durante os conflitos armados, passarem a ser considerados como crime. É a jurisprudência resultante dos Tribunais Penais Internacionais que, associada à contínua pressão internacional, acaba por ser decisiva na defesa dos direitos da mulher nos conflitos armados, consolidando como crime de guerra, crime contra a humanidade ou crime de genocídio, os actos de violência sexual ocorridos nestes.
