Abstract

This study focuses on the incentives for foreign investment applied to natural personals: Regime Fiscal do Residente Não Habitual (RNH – non-habitual resident tax regime) and Autorização de Residência para Atividade de Investimento (ARI – Resident Permit for Investment Activities) - Visa Dourados (Golden Visa). The purpose was to analyse in a more detailed and comprehensive way the main tax and legal aspects of the two regimes which are globally relevant. Key issues are addressed regarding the concept and understanding of what is meant by RNH and Visto Dourado (Golden Visa) and analyse the legal framework, features, purposes, requirements, taxation, benefits and results of the tax regimes under study. The study includes the international double taxation regime relevant for the Tax Regime RNH and the taxation of real estate investment ARI - Visas Dourados (Golden Visa). It also analyses the possibility of establishing a liaison between the two regimes, as well as draws a comparative analysis of some jurisdictions where similar regimes prevail.

O presente estudo tem por tema os Incentivos ao Investimento Estrangeiro ao nível das pessoas singulares: o Regime Fiscal do Residente Não Habitual (RNH) e a Autorização de Residência para Atividade de Investimento (ARI) – Vistos Dourados (Golden Visa), tendo por objetivo a análise mais pormenorizada e abrangente dos principais aspetos fiscais e legais subjacentes à aplicação dos dois regimes com relevância a nível global. São abordadas questões essenciais quanto ao conceito e compreensão do que se entende por RNH e Visto Dourado (Golden Visa), assim como analisados o enquadramento legal, caraterísticas, objetivos, requisitos, tributação, vantagens e resultados dos regimes em estudo. É abordado o fenomeno da dupla tributação internacional que releva para o Regime Fiscal do RNH e a tributação do investimento imobiliário da ARI – Vistos Dourados (Golden Visa). É também verificada a possibilidade de articulação entre ambos os regimes, bem como efetuada uma análise comparativa de algumas jurisdições onde vigoram regimes similares.
