Abstract

Em todos os processos que correm nos tribunais comuns trabalha-se com factos, ou seja, acontecimentos naturais ou atos humanos que o Direito considera como causas de determinadas consequências juridicamente consagradas. Sabe-se que o deferimento ou indeferimento da tutela jurisdicional é exclusivamente dependente da atividade cognitiva do juiz que, através da análise dos factos controvertidos e produção das provas vai formar o seu juízo de valor. Para atingir a verdade desses factos o juiz pode valer-se de meios como a prova documental, testemunhal e pericial. A prova pericial, objeto do nosso estudo, é um meio de prova muito peculiar, na medida em que a análise do facto que carece de prova depende de conhecimentos técnicos ou científicos que, em regra, o juiz não detém. O juiz é expert na aplicação do Direito e não é obrigado a ter conhecimentos de toda e qualquer matéria. Por isso, auxilia-se do perito que é um profissional habilitado e detentor de conhecimentos técnicos que o vão auxiliar na decisão da causa. Aí opera a prova pericial. Este trabalho visa um estudo geral da prova pericial no âmbito processual civil, incluindo uma investigação histórica e um particular debruce nos exames de reconhecimento de letra.
