O regime de exigibilidade de caixa no IVA

Abstract

O Imposto sobre o Valor Acrescentado sucedeu ao imposto de transacções em 1986. Este imposto é um imposto indirecto, geral sobre o consumo e de matriz comunitária. Para que possamos ter noção de quando o imposto é devido e se torna exigível por parte do Estado, é essencial ter em conta as normas sobre o facto gerador e a exigibilidade do imposto. A Lei 15/2009, que entrou em vigor a 1 de Janeiro de 2009, consagra um novo regime de exigibilidade do IVA para as prestações de serviços de transporte rodoviário nacional de mercadorias. Este regime é optativo na medida em que as transportadoras podem optar pelo regime geral, em que o imposto só é exigível no momento da colocação dos bens à disposição do adquirente ou da prestação efectiva de determinado serviço. Já no regime de exigibilidade numa base de caixa, o imposto só se torna exigível no momento em que se efectua a liquidação do documento de facturação. Em outros países da UE existem regimes semelhantes, em termos de exigibilidade de imposto como: Alemanha, Bélgica, França, Irlanda e Reino Unido. A implementação do regime numa base de caixa na área do transporte nacional de mercadorias, foi avaliada e analisada, tendo sido apurado uma fraca adesão a este regime, por motivos de diversa ordem. O regime foi apontado como muito desvantajoso, sendo que se deve ao aumento dos aspectos burocráticos e administrativos, para além da pressão efectuada pelos clientes para não opção.

The Value Added Tax succeeded tax transactions in 1986. This tax is an indirect tax, general consumption tax, and Community array. So we can be aware of when the tax is due and is payable by the State, it is essential to take into account the rules on the event and chargeability of tax. 15/2009 Law, which entered into force on January 1st 2009, establishes a new scheme in which payment of VAT for the supply of domestic road transport of goods. This scheme is optional in that the carriers can opt for the general, where the tax is only payable at time of entry of goods to the purchaser or the actual provision of certain service. In the scheme liability on a cash basis, the tax only becomes payable when it is carried out the liquidation of the billing document. In other EU countries there are similar schemes in terms of tax liability as Belgium, France, Ireland and the UK. The implementation of the scheme on a cash basis in the area of national goods transport, was evaluated and tested, having been discharged, a low uptake of the scheme, for reasons of various kinds. The scheme has been identified as very unfavorable and is due to increased bureaucratic and administrative aspects, in addition to the pressure made by customers not to switch.
