A presente Dissertação tem como objetivo analisar e expor os efeitos da declaração de insolvência de uma sociedade comercial nas relações laborais existentes com os seus trabalhadores. Num momento inicial, será feita uma abordagem geral ao conceito de insolvência, através do enquadramento jurídico do processo insolvencial e possíveis desfechos da empresa insolvente. Numa fase posterior, abordaremos a questão dos créditos laborais e respetiva caracterização e graduação e que posições pode o trabalhador adotar perante esta situação. Num momento final, será feita uma breve referência aos mecanismos de proteção do trabalhador, como o Fundo de Garantia Salarial.

The aim of this Dissertation is to analyze and explain the effects of the declaration of insolvency of a commercial company on the labor relations with its employees. Initially, a general approach will be made to the concept of insolvency, through the legal framework of the insolvency process and the possible outcomes for the insolvent company. At a later stage, we will address the issue of labour claims and their characterization and classification, and what positions employees can adopt in this situation. Finally, there will be a brief reference to employee protection mechanisms, such as the Salary Guarantee Fund.
