Abstract

Na presente dissertação analisamos o regime jurídico do “teletrabalho”, desenvolvendo em especial a matéria do “acordo de teletrabalho” e de alguns aspetos do seu conteúdo mínimo obrigatório – na sequência da alteração legislativa operada pela Lei n.º 83/2021 – a saber: o “local de trabalho” e o “tempo de trabalho”. Explicamos ainda a articulação do teletrabalho com o conceito de “acidente de trabalho”, evidenciando os problemas e insuficiências jurídicas da legislação acidentária que podem surgir neste âmbito.

In this dissertation, we analyze the legal regime of 'telework', specifically developing the subject of the 'telework agreement' and some aspects of its mandatory minimum content - following the legislative amendment made by Law No. 83/2021 - namely, the 'place of work' and 'working time.' We also explain the articulation of telework with the concept of 'work accident,' highlighting the legal problems and inadequacies of accident legislation that may arise in this context.
