Abstract

A marca sonora é uma realidade mundial, tanto no marketing, como nos ordenamentos jurídicos. No entanto, o ordenamento jurídico brasileiro nega o registo de tais marcas, na medida em que estas não são visualmente percetíveis. É nesse sentido que importa estudar: o direito, norte-americano e da União Europeia, que protege tais sinais; interpretações alternativas da lei brasileira, a fim de abarcar marcas sonoras; outras áreas do direito brasileiro que eventualmente poderão proteger esse tipo de sinal (concorrência desleal e direitos autorais). Não menos importante é o direito internacional, que influenciou na introdução do requisito e poderá influenciar na ampliação do conceito de marca brasileiro.

The sound trademark is a worldwide reality, both in marketing and in legal systems. However, the Brazilian legal system denies the registration of such trademarks, as they are not visually perceptible. In this sense, it is important to study: North American and European law, which protects such signs; alternative interpretations of Brazilian law, in order to protect sound trademarks; other areas of Brazilian legal system that may eventually protect this type of signal (unfair competition and copyright). No less important is international law, which influenced the introduction of the requirement and may influence the expansion of the Brazilian trademark concept.
