Abstract

O presente trabalho se propõe a analisar os impactos das mudanças climáticas nos contratos, em especial no que se refere à questão da previsibilidade e a possível relativização desta em razão a eventos climáticos. São analisados a questão das mudanças climáticas, o estágio atual do debate científico sobre o tema e uma análise jurídica sobre o que já foi feito pelo governo Português. Será também abordada a questão da previsibilidade e o seu impacto no direito contratual. Por fim, será proposta uma reflexão sobre eventual necessidade de flexibilização da habitual presunção de imprevisibilidade de eventos climáticos e sugestões para tratamento deste tema em contratos.

The present work proposes to analyze the impacts of climate change on contracts, especially regarding the issue of predictability and its possible relativization due to climatic events. The paper will analyze the issue of climate change, the current stage of the scientific debate on the subject and a legal analysis of what has already been done by the Portuguese government. The matter of predictability and its impact on contract law will also be addressed. Finally, a reflection will be proposed on the possible need to relax the usual presumption of unpredictability of climatic events and suggestions for dealing with this topic in contract law.
