A tutela do prestador de trabalho noturno

Abstract

A presente dissertação tem como objetivo refletir sobre a posição da tutela no que respeita ao trabalho noturno de um trabalhador. A importância deste tema prende-se com o facto deste tipo de trabalho para além de ser uma das modalidades de organização do tempo de trabalho, ser também uma das formas mais penosas de o realizar, sendo até merecedor de um tratamento especial na lei portuguesa, noutros sistemas jurídicos e internacionalmente. Pretende-se com esta dissertação concluir quais as vantagens do trabalho noturno e as suas consequências na vida dos seus atores. Pretende-se também identificar corretamente este tipo de trabalho, bem como os seus trabalhadores. O trabalhador noturno é merecedor de uma tutela adicional comparado com os trabalhadores comuns e, por essa razão, ir-se-ão analisar os aspetos relacionados com a duração do trabalho, a proteção da saúde e segurança deste trabalhadores, bem como o regime remuneratório associado a este tipo de trabalho.

As the primary goal, the following dissertation has to reflect upon the guardianship in regarding an employee’s nighttime work. This subject’s relevance relates to the nature of the work being one of the organizational procedures of working time and because it is one of the hardest to carry out, thus deservingly having a special treatment in the Portuguese law, other legal systems and also internationally. This dissertation intends to settle the advantages of night work and the implications of this nature of work in the lives of those involved. It is also designed to correctly identify this sort of work, as well as their workers. Night workers also possess an additional guardianship when comparing to everyday workers, so there will be an in-depth analysis of the several aspects of this type of work, such as the duration of work, health and safety protection of the workers as well as the remuneration scheme associated to this type of labor.
