Os desafios atuais à contratação coletiva

Abstract

A presente tese pretende tratar sobre os desafios atuais à contratação coletiva. Com efeito, este instituto, que surgiu como uma ferramenta ao serviço dos direitos e interesses dos trabalhadores tem vindo, recentemente, a deparar-se com um conjunto de reptos de resposta difícil. De facto, a mudança da sociedade, em geral, e do mundo do trabalho, em particular, implicaram a alterar num conjunto de pressupostos em que a contratação coletiva tradicionalmente se movia. Perante estas alterações, impõe-se reagir, para que esta figura possa continuar a desempenhar com as suas funções adequadamente. Ademais, o legislador, ora com o propósito de estimular a contratação coletiva, ora com objetivo de proporcionar respostas durante os períodos de crise, tem introduzido um conjunto de alterações ao regime desta figura. Algumas das quais de conformidade constitucional dúbia e, também, pouco sintonizadas com o natureza e os fins desta figura. Desta feita, ao longo deste trabalho, iremos abordar questões como o papel dos sindicatos na contratação coletiva, o fenómeno da contratação coletiva transnacional, o regime de eficácia subjetiva desta figura e algumas das mais relevantes mudanças que se realizaram ao regime legal desta figura, como a erosão do princípio do tratamento mais favorável, a introdução do mecanismo da caducidade das convenções coletivas, as mudanças aos critérios para a emissão de portarias de extensão, entre outros.

This thesis intends to address the current challenges to collective bargaining. In fact, this institute, that first came to light as tool at the service of employees’ rights and interests, has recently come across a number of hard to solve questions. In fact, the modifications in society, in general, and the world of work, in particular, have produced several changes to the set of assumptions in which collective bargaining has traditionally moved. Faced with these shifts, we must react so that collective bargaining can fullfil its role properly. Furthermore, the Legislator, sometimes with the purpose of stimulating collective bargaining, sometimes aiming to provide answers during times of crisis, has introduced a set of alterations to its regime. Some of which are of dubious constitutional conformity and also poorly attuned to the nature and purposes of this figure. Therefore, throughout this essay, we will address issues such as the role of unions in collective bargaining, the phenomenon of transnational collective bargaining, the subjective effectiveness of this figure and some of the most relevant changes that have taken place in the legal regime of this figure, such as: the erosion of the principle of most favorable treatment, the introduction of the expiry mechanism of collective agreements, changes to the criteria for issuing extension orders, among others.
