Abstract

La subsidiarité est un principe de loi naturelle qui régit les compétences em fonction de leurs propres responsabilité. C`est aussi un principe démocratique dans la mesure où son application enpêche l`omnipotence des institutions et de l`Etat. Nous reconnaissons que l´Etat doit agir aux côtés des autres communautés qui le précèdent, être complémentaire et aussi subsidiaire. Le pouvoir doit être partagé par toutes les structures de la société et exister dans un environnement de réciprocité où chacun assume ses droits et ses devoirs. Il incombera à L`Etat, en tant qu`élément fondamental visant au bien commun, respecté les responsabilités et les capacite de tous, les encouragerant avec la même conviction que celle qu´il empreinte dans la poursuite de ses responsabilités. Nous avons l´intention de démontrer que la subsidiarité est une doctrine politique d`application juridique et administrative et un modèle étatique avec des orientations d`organisation interne et externe. L`État subsidiare exerce une fonction interne lorsqu`il répond, dans son territoire, aux nouveaux défis de la population: Etat social subsidiaire. E il a une function externe en tant que matrice qui oriente l`organisation internationale- Etat souverain subsidiaire. L`Etat subsidiaire sèrige sur des concepts fondamentaux que nous appelons príncipes structurants: liberté, responsabilité, participation, créativité, solidarité et próximité. Unis pour le bien comum, les principes structurants de L´Etat subsidiaire assimilent la matrice philosophique de l´idée de subsidiarité avec síècles de la tradition judéo-chrétienne européenne que nous ne pouvons pas oublier.

Subsidiarity is a natural law principle that regulates competences based on their own responsibilities. It is also a democratic principle insofar as its application prevents the omnipotence of the institutions and the State. We recognize that the State must act alongside the other communities that precede it and, in addition to being a substitute, must be subsidiary. Power must be shared by all structures of society and co-exist in an environment of mutual reciprocity where everyone assumes their rights and duties. It will be up to the State, as a fundamental element for the common good, to frame the responsibilities and capacities of all, encouraging them with the same conviction as their responsibility assumes. We intend to demonstrate that subsidiarity is a political doctrine in the legal and administrative applications and is a model of State with orientations of internal and external organization. The subsidiary State has an internal function when it responds to the new challenges of its population within its territory - subsidiary welfare State. And it has an external function as the guiding matrix of the international organization - subsidiary sovereign state. The subsidiary state is built on fundamental concepts that we call structural principles: freedom, responsibility, participation, creativity, solidarity and proximity. United for the sake of the common good, the structuring principles of the subsidiary State assimilate the philosophical matrix of the idea of subsidiarity in which the values of the Judeo-Christian tradition, with centuries of European history, prevail, and cannot be forgotten.

A subsidiariedade é um princípio de direito natural que regula as competências baseadas em responsabilidades próprias. É, também, um princípio democrático na medida em que a sua aplicação impede a omnipotência das instituições e do Estado. Reconhecemos que o Estado deve actuar a par das outras comunidades que o precedem e, para além de supletivo, deve ser subsidiário. O poder tem de ser partilhado por todas as estruturas da sociedade e conviver em ambiente de sinalagma onde todos assumem os seus direitos e deveres. Caberá ao Estado, enquanto elemento fundamental para o bem comum, enquadrar as responsabilidades e capacidades de todos, incentivando-os com a mesma convicção com que assume a persecução das suas responsabilidades. Pretendemos demonstrar que a subsidiariedade é doutrina política na aplicação jurídica e administrativa e é modelo de Estado com orientações de organização interna e externa. O Estado subsidiário tem uma função interna quando responde aos novos desafios da sua população, dentro do seu território – Estado social subsidiário. E tem uma função externa enquanto matriz orientadora da organização internacional – Estado soberano subsidiário. O Estado subsidiário edifica-se sobre conceitos fundamentais a que chamámos – princípios estruturantes: liberdade, responsabilidade, participação, criatividade, solidariedade e proximidade. Unidos pelo propósito do bem comum, os princípios estruturantes do Estado subsidiário assimilam a matriz filosófica da ideia da subsidiariedade onde predominam os valores da tradição judaico-cristã, com séculos de história europeia, que não podem ser esquecidos.
