Abstract

The financial crisis of 2007/2008 represented the triggering of the assumption of the risks that several financial instruments were facing and, consequently, of the need to adopt a capable regulatory posture - we focus our work on repos. In Portugal, in particular, this same crisis has catapulted the figure of repurchase agreements to the order of the day allowing its blessings to be explored. In this line, we intend that this Dissertation to be a computation of the main defining lines of the figure and the challenges that it faces in a convergent perspective between the legal and financial areas.

A crise financeira de 2007/2008 representou o despoletar da assunção dos riscos que vários instrumentos financeiros enfrentavam e, consequentemente, da necessidade de adopção de uma postura regulatória capaz – focamo-nos nos repos. Em Portugal, em particular, esta mesma crise catapultou a figura dos acordos de recompra para a ordem do dia permitindo que sejam exploradas as suas bendições. Nesta linha, pretendemos que esta Dissertação seja um cômputo das principais linhas definidoras da figura e dos desafios que esta enfrenta numa perspectiva convergente entre as áreas jurídica e financeira.
