A idade da imputabilidade penal

Abstract

A presente dissertação incide sobre o problema da idade da imputabilidade penal. Para um melhor tratamento do tema optou-se pela divisão em vários capítulos: começa pela Introdução, onde se expõe sumariamente o que vai ser tratado ao longo do trabalho, passando para o primeiro capítulo onde se faz uma descrição da forma como Portugal foi mudando na forma de ver e tratar os seus menores, destacam-se também os principais instrumentos internacionais que em muito influenciaram a nossa história, terminando com uma análise dos diplomas legais nacionais que regem esta matéria atualmente. Já no capítulo II abordámos a psicologia da delinquência, com referência às principais teorias existentes neste âmbito. O próximo capítulo fala dos grandes problemas que surgem por se sujeitarem menores de idade a penas de prisão e apresenta também formas possíveis de atenuar esses mesmos problemas. No capítulo seguinte, discute-se a idade da imputabilidade penal, apontando as várias posições existentes. Já no último capítulo fazemos uma descrição de dois países com sistemas diferentes do nosso e chegámos ao fim com a Conclusão, em que tentámos fazer um balanço dos problemas tratados e onde apresentámos a nossa própria posição.

This dissertation focuses on the problem of the age of criminal responsability. For a better treatment of the theme, we chose to divide it into several chapters: beginning with the Introduction, which briefly exposes what will be treated during the work, going to the first chapter where a description is made of how Portugal changed his way of seeing and treating his minors, we also highlight the main international instruments that have greatly influenced our history, ending with an analysis of the national legal diplomas that govern this matter today. In Chapter II, we approached the psychology of delinquency, with reference to the main theories in this field. The next chapter discusses the major problems in subjecting minors to prison and also presents possible ways of mitigate such problems. The next chapter discusses the age of criminal responsibility, pointing out the various positions that exist. In the last chapter we give a description of two countries with systems different from ours. We have come to an end with the Conclusion in which we try to resume the issue and where we present our own position
