Abstract

Com esta dissertação pretende-se acima de tudo compreender se, e em que medida, as sociedades comerciais, podem ser titulares de direitos de personalidade. Tendo sempre presente a Constituição da República Portuguesa e o Código Civil. Num segundo momento iremos, de igual forma, analisar se as mesmas podem ser titulares de direitos humanos constantes da Convenção Europeia dos Direitos Humanos. Por último, em conexão com o estudo realizado ao longo deste tema, iremo-nos debruçar sob as formas de proteção destes direitos, e se as sociedades comerciais se encontram suficientemente protegidas de possíveis ofensas aos direitos de personalidade.

With this dissertation it is intended above all to understand if, and to what extent, Companies can be holders of Personal Rights. Always bearing in mind the Constitution of the Portuguese Republic and the Civil Code. Additionally, we shall examine whether these Companies can be holders of Human Rights according to the European Convention on Human Rights. Finally, in connection with the study carried out along this matter, we will focus on ways of protecting these rights, and whether Companies are sufficiently protected from possible offenses against their own personality rights
