Crime subjacente ao crime de branqueamento

Abstract

Introdução. O crime de branqueamento encontra-se previsto no livro II, título IV, capítulo III, artigo 368.º-A do Código Penal. Efetivamente trata-se de um crime contra a realização da justiça que se pode traduzir num processo de conversão, transferência, auxilio ou facilitação de alguma operação ou transferência de vantagens com o fim de dissimular a sua origem ilícita. O crime de branqueamento também pode consistir no processo de ocultação ou dissimulação da verdadeira natureza, origem, localização, disposição, movimentação ou titularidade das vantagens ou os direitos a ela relativos. Objectivo. O crime de branqueamento constitui um fenómeno à escala mundial, sendo que a sua punição está intrinsecamente ligada à prática de um crime precedente que lhe serve de base. Com efeito, através da realização da presente dissertação, pretendeu-se aflorar as consequências jurídicas do crime subjacente ao branqueamento quando aquele é perpetrado fora do ordenamento jurídico interno.

Introduction. The crime of laundering is in the book II, title IV, chapter III, article 368º - A of the Penal Code. In fact, it’s a crime against the implementation of justice that can be translated into a process of conversion, transfer, aid or facilitation of some operation or transfer of advantages in order to conceal its illicit origin. The crime of laundering may also consist of the process of hiding or concealment of the true nature, origin, location, disposition, movement or ownership of the advantages or the rights. Objective. The crime of money laundering is a phenomenon on a worldwide scale, and its punishment is intrinsically linked to the practice of a previous crime on which it’s based. In fact, through the preparation of this dissertation, it was intended to highlight the legal consequences of the crime underlying money laundering when it is perpetrated outside the domestic legal system.
