O princípio da dignidade da pessoa humana é um manto que perpassa toda a ordem jurídica e que possui suficiente materialidade para atribuir linhas orientadoras ao poder legislativo e ao poder jurisdicional. Com efeito, embora a dignidade da pessoa humana não seja classificada como um direito fundamental stricto sensu, acaba por ser um princípio de cariz multifuncional e que assume uma projeção normativa não despicienda.
The principle of human dignity is a mantle that permeates the entire legal system and has sufficient materiality to provide guidelines to the legislature and the judicial power. Indeed, although the dignity of the human person is not classified as a fundamental right stricto sensu, it turns out to be a principle of a multi-functional nature and that undertakes a considerable normative projection.
