A psicologia e o direito: Considerações sobre as perícias em contexto forense

Abstract

O presente trabalho pretende ser uma reflexão acerca do cruzamento científico entre a psicologia e o direito. Na justiça, sempre que se torna necessário uma análise técnicocientifica do comportamento criminoso, o juiz pode recorrer à Psicologia ou à Medicina, através de instrumentos e meios de prova previstos na Lei – As perícias. Procurou-se reflectir acerca da relevância da psicologia enquanto instrumento de análise do comportamento criminal, através deste instrumento em particular na determinação da culpa. Após o enquadramento teórico do problema e das definições conceptuais pertinentes, exemplificámos o seu meio operatório, através da análise de um processo judicial que nos serviu de guia à reflexão. Nesse percurso verificámos que há comportamentos criminais que têm necessariamente de ser interpretados não só à luz da Lei, mas também da personalidade do agente e à face das circunstâncias do meio, fazendo surgir um desejável investimento em áreas como a psicocriminologia.

ABSTRACT: This study is a reflection on the scientific intersection between psychology and law. In justice, whenever it becomes necessary technical and scientific analysis of criminal behavior, the judge may resort to psychology or medicine, through tools and evidence provided in the Law - The psychological evaluation. We tried to reflect on the relevance of psychology as a tool for analysis of criminal conduct, in particular the determination of guilt. After the theoretical approach to the problem, of conceptual definitions and relevant examples of the way their operation, through analysis of a lawsuit that served as a guide to reflection. Along the way we found that there is criminal behavior necessarily have to be interpreted not only in light of the law but also the personality of the criminal agent and is circumstances of the social environmet, and that in this theme it would be desirable an investment in areas such as psychocriminology.
