La naturaleza jurídica de las penalidades contractuales

Abstract

El presente trabajo tiene por objeto abordar una cuestión elemental de las penalidades en la contratación pública como es su propia naturaleza jurídica. Cuestión que, pese a llevar reguladas en nuestro ordenamiento seis décadas, aún es poco clara a la vista de la actual regulación, sin que la doctrina ni la jurisprudencia hayan dado una respuesta plenamente satisfactoria desde nuestro punto de vista. Con esta intención, analizaremos de manera ordenada las diferentes naturalezas jurídicas que se han defendido desde su regulación en la contratación pública, estas son: su posible naturaleza coercitiva, su naturaleza indemnizatoria y su naturaleza sancionadora.

Despite the fact that contractual penalties have been regulated in our legal system for six decades, a very elementary issue as its legal nature remains unclear. Neither doctrine nor jurisprudence have given, from our point of view, a fully satisfactory answer. This paper aims to analyse systematically the different legal natures that have been defended since its regulation in public procurement. Thus, it will analyse its possible coercive, compensatory and sanctioning nature.
