Abstract

El trabajo supone uno de los acercamientos jurídico laborales más completos desde la perspectiva comparada. No solo se contextualiza el fenómeno del trabajo en plataformas, sino que se pretende una clara delimitación dentro del fenómeno y, con ello, un claro cuestionamiento con la tendencia al uso entonces de encuadrar la actividad de tales plataformas dentro de la mal llamada aquí economía colaborativa. A partir de los instrumentos comunitarios, y las sentencias del TJUE existentes, el estudio pretende reconstruir la naturaleza no solo profesión de los servicios que se realizan en este tipo de empresas, sino también los elementos que la singularizan como por cuanta ajena. En particular, y sobre la base del llamado haz de indicios de laboralidad -ajustándolos al trabajo en plataformas- y de un importante análisis de la doctrina judicial comparada existente al momento sobre la materia (Inglaterra, Francia, Italia, etc.), se concluye afirmando la naturaleza asalariada de gran parte del trabajo prestado en plataformas. Argumentos que posteriormente veríamos utilizados en nuestro país por el TS en su sentencia de 2020. Pero, además de analizar esta cuestión, principal en tales fechas en la doctrina iuslaboralista, el estudio se adentra en aspectos escasamente tratados por los estudios del momento: el ajuste del marco laboral existente en nuestro pais al trabajo por cuenta ajena prestado para plataformas (contratación, tiempo de trabajo, retribución, externalización, etc.). Finaliza la investigación con varias propuestas de ordenación normativa de este tipo de trabajo y, en general sobre el trabajo personal sans phrases
