Abstract

Del concepto de propiedad absolutista extremado e individualista, la institución evoluciona a la vez que evoluciona la sociedad, haciéndose necesaria la imposición de límites legales al derecho de los propietarios que se van a coordinar para conseguir mejores resultados en la práctica de las relaciones sociales. Esta evolución que tiene su punto de partida en la ley de las XII Tablas, será desarrollada después por el Edicto del Pretor y por las decisiones de los juristas clásicos en atención a exigencias y necesidades variadas (agrícolas, urbanísticas, religiosas, higiénicas, estéticas, etc.) tanto en interés público como privado en el marco de las relaciones de vecindad, donde el concepto de inmisión y su nivel de tolerancia debe ser delimitado.

From the concept of extreme absolutist and individualistic property, the institution evolves as society evolves, making it necessary to impose legal limits on the right of owners to be coordinated to achieve better results in the practice of social relations. This evolution that has its starting point in the law of the XII Tables, will be developed later by the Edict of the Praetor and by the decisions of the classical jurists in attention to varied demands and needs (agricultural, urban, religious, hygienic, aesthetic, etc.) both in the public and private interest in the context of neighborhood relations, where the concept of immission and its level of tolerance must be defined.
