La vigilancia de las fronteras marítimas de la Unión Europea. Derechos humanos y abuso de derecho

Abstract

En esta monografía se aborda el régimen jurídico de la actividad de vigilancia en las fronteras marítimas de la UE. Las particulares circunstancias de la fronteras marítimas de la UE hicieron necesario un estudio exhaustivo en materia de Derecho Internacional del Mar; en concreto, sobre el régimen jurídico de salvamento marítimo. Precisamente, en las interferencias y correlaciones entre régimen jurídico de vigilancia fronteriza y el régimen jurídico de salvamento marítimo reside la principal aportación de este trabajo: el planteamiento de la posible apreciación de abuso de derecho (a la vida, en forma de rescate) en aquellos casos en los que los migrantes utilizan embarcaciones de fortuna para entrar irregularmente en Italia y España, evitando que se ejerzan sobre ellos las actividades de vigilancia fronteriza que corresponderían en circunstancias normales.
