Abstract

El reconocimiento, hecho en el c. 1095, 3º, de la incapacidad para asumir las obligaciones esenciales del matrimonio como causa de incapacidad para prestar un válido consentimiento matrimonial constituye una de las novedades más relevantes del vigente Código de Derecho Canónico. Se trata de un canon innovador, en cuanto que supone el reconocimiento explícito de que la capacidad para prestar el válido consentimiento no se agota en los requisitos de uso de razón y voluntad, sino que exige propiamente la capacidad para ser cónyuge, para asumir y cumplir las obligaciones matrimoniales que el sujeto acepta al contraer matrimonio. El origen de este canon se encuentra en la ríquisima y fecunda evolución jurisprudencial y doctrinal referida a la resolución judicial y a la reflexión doctrinal sobre la capacidad para el matrimonio de personas que presentaban graves anomalías psicosexuales - especialmente la homosexualidad y la hipersexualidad (ninfomanía, satiriasis) que, aunque no afectaban a su capacidad de raciocinio ni a su libertad para contraer matrimonio, sí podían de hecho verse impedidos, por tales trastornos, en su capacidad para asumir y cumplir las obligaciones esenciales del matrimonio. En el presente trabajo, se pretende hacer un análisis de los antecedentes jurisprudenciales y doctrinales del actual c. 1095, 3º del Código de Derecho Canónico, destacando las líneas maestras de dicha evolución de la jurisprudencia de la Rota Romana y las principales propuestas doctrinales que fueron discutidas durante el largo proceso de reforma del Derecho Canónico iniciado tras la celebración del Concilio Vaticano II, proceso que culminó con la promulgación del nuevo Código en 1983.

In the present work, we want to make an analysis of the judicial and doctrinal precedents of the today´s c. 1095, 3 in the Code of Canon Law, higthlighting the broad fines of those developments of jurisprudence of the Rota Romana, and the doctrinal proposes that were discussed during the long process of the Code Law reform after the Second Vatican Council, finishing with the promulgation of the New Code, in 1983.
