Abstract

Este artículo supone un análisis objetivo de la realidad histórica y actual del Juicio por Jurado en España. El artículo 125 de la Constitución Española sólo encuentra acomodo constitucional entendiendo la participación de los ciudadanos en la vida pública como un principio rector del Derecho. Esta idea básica ha estado presente desde la Antigüedad en la historia de las civilizaciones, pero no es sino en Inglaterra y, sobre todo, en la Francia revolucionaria, donde se convierte en un instrumento político de contrapeso frente al poder del Antiguo Régimen y su brazo ejecutor en la Justicia. En España, la carga ideológica que siempre acompañó la implantación, suspensión y reimplantación del Jurado está presente a través de los siglos XIX y XX, y ello motiva la falta de arraigo histórico de esta institución que se prolonga hasta el momento actual, precisamente cuando los jueces son vistos en general como profesionales independientes en el desempeño de su labor jurisdiccional. El autor, a través de su experiencia personal, sostiene que la buena intención del Constituyente y del Legislador para fomentar una "Escuela de Ciudadanía" no está exenta de inconvenientes prácticos en su aplicación; tales comó la desgana de los candidatos, su renuencia a ser elegidos, la lentitud del desarrollo de las sesiones del juicio con las incoherencias y motivaciones insuficientes que fuertemente se observan en el veredicto, más allá del creciente retroceso que esta institución tiene en países de honda raigambre juradista.

This article is an objective analysis of historical and curren! reality of !he JuryTrial in Spain. The article 125 of the Spanish Constitution only settles constitutional arrangement by understanding the participation of citizens in public lile as a guiding principie of law. This basic idea has been present around since ancient times in !he history of civilizations, but in England and especially in France with !he French Revolution, where it turned into a political counterbalance to the Old Regime and its executive arm in Justice.ln Spain, !he ideological in the implementation, suspension and reimplantation of !he Jury is present throughout !he nineteenth and twentieth centuries, and this motivates the lack of historical roots of this institution that continuas to date precisaly whan judgas are generally sean as independent professionals in the performance of their judicial work. The author, through his personal experiance, argues that the good intention of theConstituent andtheLegislatorto allow a"CitizenshipSchool" facespractica! difficulties in its implementation, such as !he unwillingness of tha candidatas, their raluctance to be alected, the slow devalopmant of the sessions of the jury with the inconsistencies and insufficient motivation strongly observed in the verdict, bayond the growing backlash that this institution shows in deeply jury-rooted countries.
