Este trabajo estudia la responsabilidad civil por defectos constructivos, mediante el examen de los diversos regímenes jurídicos que confluyen en este ámbito. Aunque el punto de partida es el examen de la LOE, hemos prestado especial atención a la responsabilidad contractual en esta materia, incidiendo en las notas que la caracterizan y singularizan respecto a la responsabilidad legal. No en vano, hoy en día puede hablarse de un renovado protagonismo de la responsabilidad contractual en este terreno, en cuanto habilita para la reclamación de daños y perjuicios no amparados por la LOE e incluso para demandar por los mismos daños objeto de esta norma ─más allá de los plazos de garantía y prescripción que en ella se establecen─ aunque con sujeción a las reglas que disciplinan las acciones contractuales. De este modo, la tesis aborda la responsabilidad contractual por defectos constructivos, su régimen sustantivo y sus confines subjetivos y temporales, realizando un análisis comparativo respecto de la LOE.

This research explores the question of civil liability for construction defects through the analysis of the different legal regulations related to this issue. Establishing the examination of the LOE (Law on Planning and Construction) as the starting point, special emphasis has been laid on contractual liability, particularly on those features distinguishing it from legal liability. Currently, it can be stated that there is a renewed interest in contractual liability in this regard, since it entitles to action for damages not protected by LOE. Furthermore, it enables the claiming for the same damages included in this law ─regardless of the warranty and prescription periods it establishes─, although it is subjected to the regulations of contractual actions. Thus, this tesis focuses on contractual liability for construction defects, its substantive law and its subjective and temporal boundaries, including a comparative analysis with the LOE.
