Reflexión crítica sobre la fiscalidad ambiental como instrumento de protección del medio natural

Abstract

[ES]El capítulo examina desde una perspectiva crítica la fiscalidad ambiental entendida como un conjunto de instrumentos que, teniendo forma tributaria, pretenden operar como mecanismos de protección del medio natural mediante la orientación de comportamientos y la corrección de externalidades. Esta circunstancia exige valorar su idoneidad más allá de la mera recaudación. Para ello se realiza un análisis de la lógica justificativa de estos tributos, que descansa en la idea de que quien genera un daño ambiental o incrementa el coste social de determinadas actividades debe soportar una carga que refleje ese impacto ("quien contamina, paga"). Contrasta esta finalidad con los problemas reales que aparecen cuando el tributo se diseña con bases imponibles poco conectadas con el daño, con tipos que no reflejan adecuadamente la intensidad de la externalidad o con exenciones y modulaciones que debilitan el efecto incentivador. Desde esa perspectiva, el capítulo no se limita a una descripción del fenómeno, sino que propone una lectura jurídico-tributaria que permite diferenciar entre fiscalidad auténticamente ambiental, que se estructura para inducir cambios y para internalizar costes, y fiscalidad solo nominalmente verde, que se apoya en una retórica ambiental sin desplegar mecanismos eficaces de corrección ni estándares robustos de coherencia normativa.
